POSTURE ALIGNMENT ACADEMY MEMBERSHIP – TERMS OF SERVICE
Effective Date: November 14, 2025
Company: Confidently Aligned, LLC (“Company,” “we,” “us”)
Member: You, the purchaser (“Member,” “you”)
Program: Posture Alignment Academy Membership (“Membership,” “Program”)
By enrolling in the Membership, clicking “Join,” “Subscribe,” “Purchase,” or otherwise accessing the Program, you confirm that you have read, understood, and agree to be legally bound by these Terms of Service (“Agreement”).
If you do not agree, do not enroll.
1. DESCRIPTION OF MEMBERSHIP SERVICES
The Membership provides non-personalized, on-demand posture, mobility, and fitness content, which may include:
A library of on-demand posture and movement classes
Standalone programs with pre-recorded video demonstrations
Digital resources such as PDFs or guides
Access to community forums or groups
Periodic challenges
One (1) live class or workshop per month
App access for the duration of your active subscription
The Membership is not personalized 1:1 coaching and does not include individualized program design, private coaching feedback, video form checks, or messaging support unless explicitly stated.
Company may modify, update, substitute, or discontinue content, challenges, or platform features at any time, as long as substantially similar value remains available.
2. BILLING, PAYMENT, AND AUTO-RENEWAL
2.1 Subscription Options
You may enroll in either:
Monthly subscription
Annual subscription
2.2 Auto-Renewal
Your subscription will automatically renew at the end of each billing cycle (monthly or annual) at the rate in effect at the time of renewal, unless canceled at least 24 hours before your next billing date.
2.3 Price Changes
Company may adjust membership pricing at any time.
If prices change, you will be billed at the rate in effect at the time of your renewal, not retroactively.
You are responsible for reviewing updated pricing before renewal.
2.4 Payment Authorization
By subscribing, you authorize Company to automatically charge your payment method on file until you cancel.
2.5 Failed Payments
If a payment fails, Company may:
Retry payment
Suspend your access
Terminate your membership
Refer the unpaid amount to collections
3. CANCELLATION & ACCESS RIGHTS
3.1 How to Cancel
Members may cancel anytime inside their account settings.
E-mail requests are not guaranteed unless confirmed in writing.
3.2 Access After Cancellation
When you cancel, access remains active until the end of your current billing cycle.
You will not receive prorated refunds for unused time.
3.3 No Refunds
All membership payments are final and non-refundable, including but not limited to:
Change of mind
Dissatisfaction
Lack of participation
Technical issues on Member’s side
Scheduling conflicts
Injury or medical changes
Forgetting to cancel before renewal
4. NO MEDICAL ADVICE & ASSUMPTION OF RISK
4.1 No Medical Guarantees
The Membership is educational and fitness-based.
The Company does not diagnose, treat, or guarantee improvement in any medical or physical condition.
4.2 Consult Your Doctor
Member is responsible for consulting a qualified medical provider before beginning any exercise program.
4.3 Assumption of Risk
Member voluntarily assumes all risks associated with movement, exercise, posture training, and participation in any aspect of the Membership.
4.4 Release of Liability
Member releases Company, Coach, employees, and affiliates from all liability related to injuries, adverse reactions, or damages arising from participation even if caused by negligence.
5. TECHNOLOGY, APP ACCESS & LIMITATIONS
Member is responsible for:
Reliable internet
A compatible device
Keeping the app updated
Maintaining login credentials
Technical issues on the Member’s side do not justify refunds, credits, or extensions.
Company may limit, suspend, or revoke access for:
Late payment
System misuse
Harassment
Breach of terms
6. INTELLECTUAL PROPERTY & LICENSE
All Membership content including videos, routines, PDFs, programs, trainings, text, images, platform structure, and all intellectual property is owned exclusively by Confidently Aligned, LLC.
Members may NOT:
Share their login
Distribute content
Upload or post Membership content elsewhere
Create derivative programs
Use the content for commercial purposes
Share videos or guides with non-members
Violation may result in immediate termination without refund and legal enforcement.
7. COMMUNITY BEHAVIOR & TERMINATION RIGHTS
If a community forum is included, Member agrees to:
Be respectful and constructive
Not post harmful, hateful, or inappropriate content
Avoid spam, solicitation, or promotion of other programs
Company may remove any Member from the community or terminate membership entirely for:
Harassment or disruptive behavior
Boundary violations
Abuse of staff or other members
Attempted chargebacks
Sharing copyrighted content
Illegal or unethical behavior
Termination for misconduct does not qualify for refund.
8. NO GUARANTEE OF RESULTS
Member understands that outcomes depend on their consistency and effort.
Company does not guarantee:
Pain relief
Posture correction
Fitness transformation
Mobility improvements
Weight loss
Any specific outcome
9. MARKETING CONSENT
By participating in community areas or submitting voluntary testimonials, wins, or messages, Member grants Company permission to use anonymized progress or statements for marketing unless they opt out in writing.
No photos or videos are used without explicit written permission.
10. CHARGEBACKS & DISPUTE RESOLUTION
10.1 Chargebacks Prohibited
Because Member has full and immediate access to digital content, Member agrees not to file chargebacks or payment disputes.
10.2 If a Chargeback Is Filed
Company may:
Contest the chargeback with evidence
Terminate Member’s access
Send unpaid fees to collections
Pursue legal fees and damages
10.3 Dispute Resolution
If a disagreement cannot be resolved informally, Member agrees to binding arbitration in the State of Texas.
Member waives the right to participate in class actions or jury trials.
11. GOVERNING LAW
This Agreement is governed by the laws of the State of Texas.
12. ENTIRE AGREEMENT
This document constitutes the entire agreement between Member and Company.
No oral statements or prior conversations override these terms.
